The Supreme Court ruled that the Trump administration must facilitate Garcia’s return to the U.S. US District Judge Paula Xinis stated that Garcia was detained “without lawful authority” and held “without legal basis,” in direct violation of U.S. law. Despite the ruling, Garcia’s family faces a tough battle. After a meeting between Trump and El Salvador’s president, Nayib Bukele, it was decided that Garcia’s return depends on Bukele. However, Bukele refused, saying, “How can I smuggle a terrorist into the United States?” He added that El Salvador had transformed from the “murder capital of the world” to “the safest country in the Western Hemisphere,” and he would not undo that progress by releasing criminals.

Garcia, an immigrant who arrived in the U.S. at age 14, had been granted legal protection from deportation by a U.S. immigration judge in 2019 due to gang threats in El Salvador. His wife, Jennifer Stefania Vasquez Sura, has consistently spoken out against the injustice of his deportation.
