A Troubling Start to the Year for Dr. Emmanuel Hostin

The new year has begun with challenges for Dr. Emmanuel “Manny” Hostin, husband of The View co-host Sunny Hostin. Dr. Hostin, a respected orthopedic surgeon, is among nearly 200 defendants named in a major RICO (Racketeer Influenced and Corrupt Organizations) lawsuit in New York. He faces serious allegations of federal insurance fraud, accused of accepting kickbacks in exchange for unnecessary surgeries.

The Fraud Allegations

The lawsuit, filed on December 17, 2023, claims Dr. Hostin performed unnecessary arthroscopic surgeries and billed American Transit, an insurance company covering taxi, Uber, and Lyft drivers. The suit alleges that he received improper payments, disguised as “dividends,” for referring patients to specific medical centers.

Dr. Hostin’s attorney, Daniel Thwaites, vehemently denies the accusations. He calls the lawsuit a “blanket, meritless” attack from a struggling insurance company. Thwaites argues that American Transit failed to properly investigate the claims and is using the lawsuit to harass healthcare providers. He also defends Dr. Hostin’s impeccable reputation.

Sunny Hostin’s Public and Family Life

Sunny Hostin, 56, has been married to Dr. Hostin for over 20 years. The couple, who wed in 1998, have two children and live in an upscale home in Purchase, New York. Despite the challenges, the couple has endured. In 2021, Sunny revealed the heartbreaking loss of Dr. Hostin’s parents, both doctors, to COVID-19 during the holiday season.

American Transit accuses Dr. Hostin of receiving kickbacks for referring patients to a surgery center, performing unnecessary procedures on minor accident victims. The insurer claims these fraudulent surgeries violate New York’s “No-Fault Law,” which covers accident victims’ medical expenses. They argue that such fraud destabilizes the insurance market and raises premiums for taxi and ride-share drivers.

The insurance company is seeking over $450 million in damages, claiming the fraud inflates costs and impacts hardworking drivers. They argue that the abuse of the No-Fault Law has led to millions in improper payments.

Legal Experts Weigh In

Legal experts are divided on the case’s merits. Some, like William Natbony of American Transit, stress the need to fight fraud to protect consumers. Others, such as defense attorney Steven Harfenist, believe the lawsuit may be a last attempt by American Transit to recover lost funds by targeting small medical practices that might settle to avoid lengthy litigation.

As the legal battle unfolds, both Sunny and Dr. Hostin face a tough road ahead. Their public lives and family reputation are closely tied to the outcome of this high-stakes case.
