On May 9, 2025, a group of Democratic lawmakers, including Representatives LaMonica McIver, Bob Menendez, and Bonnie Watson Coleman, along with Newark Mayor Ras Baraka, entered the Delaney Hall ICE Detention Facility in Newark, New Jersey, without authorization. Their intent was to investigate detainee conditions, but the visit escalated into a physical altercation with ICE officers.

Body camera footage reportedly shows Representative McIver pushing a female ICE officer to the ground. The Department of Homeland Security (DHS) has indicated that legal action, including possible arrests, is being considered against those involved.

Governor Kristi Noem issued a strong rebuke, emphasizing that unauthorized entry and assault on federal officers are serious offenses, regardless of the individuals’ positions. She stated, “Any individual, regardless of office, who engages in assaulting federal officers or unlawfully enters restricted federal facilities will face the consequences.”

The incident raises legal questions about the limits of legislative immunity. While lawmakers have protections under the U.S. Constitution’s Speech or Debate Clause, these do not extend to criminal acts outside their legislative duties. Legal experts anticipate that courts will examine whether the lawmakers’ actions were within the scope of their official responsibilities or constituted unlawful conduct.
